Terms of Use

These Terms of Use (“Terms”) govern your use of the Ifscape iPhone app and the website at ifscape.com (together, the “Service”), operated by Ifscape (“we”, “us”).

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you purchase or subscribe through the Apple App Store, Apple’s terms for the App Store and media services also apply to the transaction.

1. The Service

Ifscape is a glass camera experience for iPhone. You can place glass-made objects in front of a live scene or photo and capture a picture that includes both.

Some features are free. Additional features may be offered as Ifscape Plus through one-time purchase, subscription, or other in-app purchases.

We may change, improve, suspend, or discontinue parts of the Service over time, including optional cloud features that depend on external infrastructure.

2. Eligibility

You must be able to form a binding contract under applicable law to use the Service. If you are under the age required in your region to consent to these Terms on your own, you may use the Service only with involvement of a parent or guardian as required by law.

The Service is not directed at children under 13.

3. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Ifscape app on Apple devices you own or control, as permitted by the App Store terms, and to use the website for lawful personal purposes.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service except to the extent applicable law prohibits these restrictions.

4. Your content

You retain ownership of photos and other content you capture, import, or create with the app (“Your Content”).

You are responsible for Your Content and for having the rights needed to use it with the Service (including any people, places, trademarks, or third-party materials appearing in your photos).

If you use an optional cloud feature, you grant us a limited license to transmit and process the submitted image solely to provide that feature and return a result to you.

5. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes.
• Attempt to disrupt, overload, scrape, or reverse-engineer our servers or rate limits.
• Bypass payment, entitlement, or access controls.
• Misrepresent the Service’s output as something it is not (for example, presenting recognition results as professional medical, nutritional, or legal advice).
• Use automated systems to abuse optional cloud features.

6. Optional cloud features

Some features may upload an image to our servers for processing (for example style generation or recognition tags). Those features:

• Are optional and may require confirmation before first use.
• May be rate-limited, changed, or temporarily unavailable.
• May produce imperfect, incomplete, or incorrect results.

Recognition outputs (including calorie or vocabulary tags) are for creative and informational use only. They are not medical, dietary, educational certification, or professional advice.

7. Purchases and subscriptions

Ifscape Plus and other paid features are sold through Apple’s in-app purchase system. Payment, billing, renewal, and refund requests for App Store purchases are handled by Apple under Apple’s terms and policies.

Subscriptions renew automatically unless you cancel in your Apple ID / App Store subscription settings before the renewal date. Managing or canceling a subscription is done through Apple, not through a separate Ifscape account.

Prices shown in the app are set and displayed by Apple for your storefront. Restore Purchases is available in the app for eligible Apple purchases.

8. Intellectual property

The Service — including the Ifscape name, wordmark, app design, glass object designs we provide, software, and website materials — is owned by us or our licensors and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of our intellectual property to you. Feedback you send us may be used to improve the Service without obligation to you.

9. Third-party services

The Service may rely on third parties such as Apple, Cloudflare, and model providers used for optional cloud features. Their terms and privacy practices apply to their services. We are not responsible for third-party services we do not control.

10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that cloud features will always be available or accurate.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IFSCAPE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR IFSCAPE PLUS FEATURES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations. In those cases, the limitation applies to the fullest extent allowed.

12. Termination

You may stop using the Service at any time. We may suspend or end access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, and limitations) will survive.

13. Privacy

Our Privacy Policy explains how we handle information. By using the Service, you also acknowledge that policy.

14. Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date on this page when we do. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the Service.
